Dan Grading in Scotland

C.M.A.A. Vice President Gordon Scott-Russell has graded Mark McAllister to 4th Degree black belt in Freestyle Ju-Jitsu.

4th Dan is normally awarded for time served but on this occasion Mark was to be graded by Gordon.

After a very hard 5-hour session, which saw various students worse for ware, Mark braved everything that was thrown at him, even sparring with all members of GSR fight team one after another, well done Mark!!!

CRB Checks – Some Groups Still Ignorant!

We had cause to contact the head office of another Martial Arts Group today while checking the credentials of an Instructor on behalf of a 3rd party group.

While the Instructor was confirmed as a member we were shocked at the answer given when we asked about CRB checks, here is a direct quote:

“We don’t have CRB checks done as they are not required, our insurer used to ask for them but they don’t anymore so we don’t ask our members to have them done”

When we asked if they were aware of the changes to UK law the answer given was:

“No, but I’m sure we have someone in the group who can do them, I just can’t remember who it is”

This is shocking and again we are not going to 'name and shame' the group, but everyone reading this please spread the word that it IS now law and from November this year anyone not complying IN FULL could face prosecution!

ISA Registration forms will be available from 26th July and anyone with a current CRB check will have 5 years to comply.

ISA Clarification

There seems to be some confusion over the forthcoming ISA registration in that some members have asked why they will still be required to under go CRB re-checks every 2 years once registered.

The confusion stems from the following statement which has been released by the ISA:

When a person becomes ISA registered they will be continuously monitored and their status reassessed against any new information which becomes available”.

To clarify any new convictions or cautions, received after registration, will NOT automatically be sent to the ISA. Instead the ISA will be informed as a result of either:

1. Somebody informing the ISA direct by reporting the registered person.
2. CRB re-checks.

MMA Grades & Coaching Awards

The concept of a person holding a Black Belt in MMA has been discussed around the world with no real conclusion because, after all, MMA is by definition a combination of various arts and does not normally include belt gradings. However many practitioners around the U.K. are now beginning to ask to be graded in some way.

You could argue that were gradings to be introduced into MMA they would be Freestyle as this too is made up of various arts and holding these grades would not necessarily mean that a person can effectively fight at full contact level, which is the whole point of MMA. This, in turn, would make the grade pointless.

In addition for a person to claim the title of MMA Coach he/she too must have proven him/her self. Simply going on training courses etc can't be considered as proof, in our opinion. After all an Instructor of any subject proves him/her self by the success of the students he/she teaches within the given subject. We look at MMA Coaching and grades in the same light and success can only be proven within the cage or ring.

The C.M.A.A. has now put together a system to address the above problems in the fairest way that we could think of should any person approach us. For full details go to

ISA Update. Retention of criminal convictions on PNC

On 19 October 2009, a judgment by the Court of Appeal supported the retention of criminal convictions on the Police National Computer (PNC) for policing purposes.  The police are obliged under Part V of the Police Act, to provide the CRB with access to all convictions held on PNC.  The police will no longer “step-down” or “weed” convictions, cautions, reprimands or warnings from the PNC, which means that all convictions will be retained on the PNC until an individual’s 100th birth date.

As a direct result of this, and as the CRB does not own the data held on PNC, the CRB will no longer accept a Dispute where the information revealed on a CRB certificate is being disputed on the basis that the police should have applied the “weeding” or “stepped down” rules.

Once a person is ISA registered (from 26th July for new applicants, from April 2011 for re-checks) they will be continuoulsy monitored and their status re-assessed against any new information which becomes available via CRB re-checks. Within the C.M.A.A. re-checks will remain mandatory every 2 years.

MMA Insurance

One of our members reported today that he had been informed that another well known and very large Martial Arts group were stating that their membership now included insurance for sparring / competting in MMA.

Andrew Morrell promoted by the World Karate & Kickboxing Council

Non Dan Grades Running Clubs

One of our member clubs contacted us recently asking if the C.M.A.A. would sanction grades below 1st Dan running classes alone, as he wanted to expand yet had no Dan grades other than himself.

While some other MA groups do allow this we of course said no as our standards are amongst the highest in the country and of that we are very proud.

Andrew Morrell said:

"The C.M.A.A. fully supports the MASA 5 in that we believe for an Instructor to run a club alone he / she must hold no less than 1st Dan or equivalent showing at least 3 to 4 years experience. Students have the right to be taught by genuine black belts who have served their time and not by a person wearing a 'special instructor belt' who has only themselves been training for a short period. In comparison a person cannot become a driving instructor unless they themselves have at least 3 and half years experience. In the end the student will make their own informed decision which is why the MASA 5 was created".

Dirty Politics, again!

In September this news page carried a story entitled 'Underhanded Tricks' which can still be seen below, dated 25.09.09.

Once again we have been contacted by an Instructor wanting help. He told us that a well known Martial Arts Group had been contacting the venues he uses informing them that he is not regulated by a larger MA Group and as such should not be teaching etc etc.... While there are certain pit falls to not being in membership to a larger body, it most certainly does not give any person the right to behave in this manner.

While it is not our intention to name and shame this group we must point out the following taken from the 2006 Fraud Act should any one else suffer this ludicrous behaviour as action can be taken to stop it:-

Fraud by false representation .(1)
A person is in breach of this section if he— .
(a) dishonestly makes a false representation, and .
(b) intends, by making the representation— .
(i) to make a gain for himself or another, or .
(ii) to cause loss to another or to expose another to a risk of loss
.
(2) A representation is false if— .
(a) it is untrue or misleading, and .
(b) the person making it knows that it is, or might be, untrue or misleading.

13.10.09 - ISA Update - Vetting & Barring

The three key changes at 12 October 2009 for MA Groups and Instructors are:

MA Groups: must not knowingly take on in regulated activity, or use as a volunteer, a barred person. If an Instructor is dismissed or ceases teaching because the MA Group thinks they harmed or pose a risk of harm to children or vulnerable adults, the MA Group must refer the case to the ISA.

Instructors: if you yourself are barred from regulated activity, you must not work, or seek to work, in regulated activity from which you are barred.

ISA Registration will run as follows over the coming months:

July 2010 - New Instructors can register with the ISA;.

November 2010 - New Instructors must register with the ISA;

April 2011 - Existing Instructors who have already been CRB checked can start to ISA-register. The ISA will publish, in good time, recommendations as to dates by when we should register and we will in-turn notify all C.M.A.A. and Affiliate members.

07.10.09 - Silly Archaic Rules

We have had a call today from a club requiring membership information.

During the call the Instructor asked that if he joined the C.M.A.A. would his club be allowed to have membership and train / compete with other non member groups. The answer was yes of course.

He then told us that his present group do not allow this. We are aware that this is happening and indeed which martial arts group has this archaic rule in place.

The only comment the C.M.A.A. has to pass is a reminder that it is an Instructors choice to join / leave a martial arts group. If a group insists on implementing silly rules like this then quite simply they are going to continue to lose members as Instructors and students both realise that they don’t have to put up with being treated in this way, as is the case today.

25.09.09 - Underhanded Tricks

From time to time, when a club leaves one Martial Arts Group in favour of joining another, the estranged group attempts to spread propaganda in an attempt to discredit the club Instructor. The common ‘theme’ of such propaganda is that he or she is not insured or qualified any more or even that the club has closed down.

This is underhanded and could even be considered as illegal if the comments are untrue or misleading with the aim of making financial gain.

We have recently heard of 2 such cases so with that in mind any person reading this article who has concerns relating to the above is invited to contact the C.M.A.A. office and we will be happy to advise you.

09.09.09 - MASA 5 is Alive!

The concept of the MASA 5 is spreading around the country and people are starting to take note at last. The timing falls in nicely with the new law changes coming next month relating to the Independent Safeguarding Authority (ISA).

This morning one of our members, in Staffordshire, tried to drop some leaflets in to a School. The secretary informed him that she was under instructions not to accept any ‘advertising’ unless a CRB check could be produced along with other documents. Obviously our Instructor was fine as he conforms to the MASA 5 in full. But she did tell him of another who had tried the same a few days earlier and when asked for his CRB stated that he did not need one as he only teaches people over 13 years old!!. That statement alone demonstrates the need for  the forthcoming changes to the law.

With that in mind we have now simplified linking to the MASA 5 page by securing the following direct domain names:

Regarding the ISA we are now beginning to receive numerous phone calls from other groups who were unaware that this was coming seeking help and advise, which we are more than happy to give based on our ethos of being an open minded ‘Supporting Body’.

15.08.09 - C.M.A.A. Membership / Insurance for under 5s

At the request of some of our members we have negotiated with Perkins Slade Ltd and are happy to report that the Insurance, included in C.M.A.A. membership, has been expanded to include children below the age of 5 years old.

Any C.M.A.A. club wanting to open classes for under 5s may now do so, but please download the guidance document which can be found in section 1 of the Instructor Area on this website.

20.07.09 - CRB Logo - A Warning

The CRB have once more issued the following warning relating to the use of their logo:

' The CRB has noticed that several organisations are displaying the official CRB logo on their websites and other internal documentation. Please be advised that the CRB and Disclosure logos are registered trademarks and can only be used with express authority from the CRB. This authority is only usually granted to other Government departments.

We do not allow or permit Registered or Umbrella Bodies to use these logos as they can often be used in a way that would suggest that the CRB promotes or endorses the service of the organisation making use of it.

If an Umbrella Body wishes to refer to the CRB service that it provides, it should use the following sentence to explain: [Name of the organisation] is registered with the Criminal Records Bureau as an Umbrella Body.


Any organisation currently using either of the logos on their website or internal documentation without permission must remove it immediately. '

21.04.09 - Protecting Vulnerable Groups - Scotland.

The Protecting Vulnerable Groups (Scotland) Act 2007 introduces a new membership scheme for people who work with children and protected adults.  This will replace current disclosure arrangements for people whose post requires an enhanced disclosure.  The Protecting Vulnerable Groups Scheme (PVG Scheme) is expected to be introduced in 2010 (an exact date is still to be determined).
