Kevin Shorthouse 3rd Dan and the Black Dragon Martial Arts Academy (Hapkido) in Cheadle, Cheshire. 27.01.12 CRB and ISA to From One Organisation - Disclosure and Barring Service The Protection of Freedoms Bill, currently passing through Parliament, includes a proposal which will see the CRB and the Independent Safeguarding Authority (ISA) become a new organisation called the Disclosure and Barring Service (DBS). The new organisation will be responsible for the delivery of the disclosure and barring services currently delivered by CRB and ISA. The Bill also includes provision for the reform of these services; for example, the introduction of a new, portable disclosure service – and the DBS will be responsible for delivering these services once they are introduced. The planned date for the new organisation to come into being is November 2012, subject to Parliamentary timetabling. Neither the CRB nor the ISA will relocate as part of the transition to the new organisation. Independent Safeguarding Authority (ISA) Clarification While the registration element of the Vetting and Barring Scheme (VBS) has been halted as part of the Coalition Government's VBS review Employers, social services and professional regulators are under a legal duty to notify the ISA of relevant information, so that individuals who pose a threat to vulnerable groups can be identified and barred from working with these group. Such information may come to light as a result of a CRB check, in addition the following applies: - * If an organisation dismisses or removes a member from working with children and/or vulnerable adults (in what is legally defined as regulated activity) because they have harmed a child or vulnerable adult the organisation have a legal duty to inform the Independent Safeguarding Authority (ISA). * An organisation which knowingly employs someone who is barred is breaking the law. * A person barred from working with children or vulnerable adults is breaking the law if they work/volunteer or seek to work/volunteer with these groups. 07.11.11. Standardisation of C.M.A.A. Certificates We are at present standardising some of the certificates issued by the C.M.A.A. This has resulted in the following changes: - 1. The alternate A3 dragon style black belt certificate is no longer available, only the cobra bordered version will be issued from now on. 2. The Martial Arts Instructor UK certificates have been re-designed so that they match the standard A4 format. Images can be seen by clicking here. M.A.A. panel in Manchester, read more here.... 13.10.11 CRB Best Practice As a CRB Registered Body we sometimes receive telephone calls and emails from facility providers asking for confirmation that a person has been through disclosure with us, quite often all these people want is the disclosure number as confirmation. However while being able to produce a disclosure number does show that a person has undergone an enhanced disclosure check, it does NOT mean that they are free of convictions that would prevent them from coming into contact with the young and vulnerable. We would urge everyone to please stop this bad practice and always ask to see the disclosure document itself. 'While the C.M.A.A. can't comment on the practices of other Martial Arts groups and their 'rules' any C.M.A.A. The reason for this is the latter is a statutory course aimed at the work place where as the new course is more relevant to what Martial Arts Instructors require. In addition HSE registration for the new course is no longer required, however the trainer must still be suitably qualified to teach First Aid. 02.08.11 C.M.A.A. Matt Marshall, of Tae Kwon Do Hawks in Southampton, contacted us recently regarding problems he was having with another club. As we could not find evidence that this club belonged to a UK based national body we simply advised him to promote the MASA 5 - www.masa5.co.uk. This he did and here is a direct quote from Matt after doing so: 'Since I plastered the MASA 5 around the centre I use and the local community centres etc people have come back to me saying that they didn’t realise how easy it was to set up a club and rip people off that don’t know much about martial arts. Some of them have even gone as far as quitting their club as their instructor couldn't explain why they didn’t have something as simple as a CRB or indemnity insurance. I would say to anyone that is having similar issues simply litter the area with info on MASA, it seems to have worked for me! (Click here) Today we have received a report from a new C.M.A.A. member stating that his ex Association have ‘banned’ him from teaching certain techniques as they hold copyright on them. Now a person may claim copyright on anything that he / she wrote or invented, however on this occasion the copyrighted material is a punch!. To quote the definition of copyright: ‘For a copyright to apply to a work, it must be an original idea that is put to use.’ As punching is not a new idea the validity of this claim in law is doubtfull and a rediculous claim engineered to harrass the club in question, which could in turn be seen as an infringment of Section 2 of the 1997 Harrassment Act. 30.03.11 Tournament Success for First Defence Tae Kwon Do Mike Beard’s First Defence Tae Kwon Do Clubs have had recent success at 2 tournaments. Member Instructors quite often ask if there is anything that can be done about clubs who don’t seem to bother about national standards relating to Instructor qualifications, gradings and insurance. Clubs of this kind are often referred to as ‘McDojos’. As MASA members the answer is simple, educate people to the MASA 5. Add the link to your literature and websites - www.masa5.co.uk. The more people who know about MASA and what it stands for the better as it will then make it harder for the ‘McDojos’ to operate. 11.01.11 ‘I CONTROL THE GRADINGS!’ Early last year we ran an article relating to ‘Chief Instructors’ taking too much control over students and fellow Instructors gradings. It should be noted that this article does not relate to any current C.M.A.A. member. We have just had an enquiry from an Instructor who has not graded since 1999. The reason being his Instructor won’t let him, or any one else for that matter, enhance their grades until HE decides without giving any viable reason as to why. Quite often the result is that the Instructor will adhere to these rules for some time, but eventually will get fed up and either quit altogether or join another group – such is the case today. Click Here. 02.12.10 Name Change for the CCPR The Central Council for Sport and Recreation (CCPR) have today changed their name to The Sport and Recreation Alliance. The following is a statement from Tim Lamb, Chief Executive I am writing to introduce the Sport and Recreation Alliance, the new name for CCPR as from today, 1 December 2010. I want to emphasise that we are still very much the same organisation, with the same excellent staff, focused on providing the same top quality service to the governing and representative bodies of sport and recreation. All that has changed is our name. We hope you agree that our new name and brand will give people a much better idea of what we do and on whose behalf we do it. Helping our 320 members and the 150,000 sports clubs around the country is at the heart of all our work and we are confident that the new brand will help us be more effective than ever. Click Here. 15.10.10 Underhanded Tricks From time to time, when a club leaves one Martial Arts Group in favour of joining another, the estranged group attempts to spread propaganda in an attempt to discredit the club Instructor. The common ‘theme’ of such propaganda is that he or she is not insured or qualified any more. Once again a new C.M.A.A. member Instructor has contacted us with this problem. We are told that the other group have been contacting the venues the club uses trying to cause problems re insurance etc. The fact of the matter is that the club is insured etc via the C.M.A.A. making the comments being passed untrue and as such they could be considered illegal: - Fraud Act 2006 – Section 2 Fraud by false representation. (1) A person is in breach of this section if he—. (a) dishonestly makes a false representation, and . (b) intends, by making the representation— . (i) to make a gain for himself or another, or . (ii) to cause loss to another or to expose another to a risk of loss. (2) A representation is false if— . (a) it is untrue or misleading, and . (b) the person making it knows that it is, or might be, untrue or misleading. Should any person have any concerns relating to any C.M.A.A. However many practitioners are now beginning to ask to be graded in some way. The most acceptable way to grade in MMA is to be judged fight per fight in competition, however some MMA clubs are not as competitive as others so how can they be graded? The same applies to accomplished fighters with nothing to show, grade wise, who then turn to teaching rather than fighting themselves and as such require a syllabus to work from offering recognised grades. We have today received an application from an Instructor wanting to join us. He submitted his current indemnity insurance certificate which was printed on a letterhead from his current Association. This carried the amount he was covered for along with a policy number and the name of the underwriting Company, but not the name or contact details of the issuing Broker. We have traced this back to the underwriter in London who confirmed the reference number was one of theirs but they could not confirm whether or not the applicant was covered with them as he was not listed on file and without the name of the Broker they could not trace him. Any person reading this who has insurance documentation on a letter head from their Association is advised to find out who the Broker is and contact them direct to ensure you are actually covered.
